1. Acceptance of Terms
By accessing or using PoshAnswers (the "Service"), operated by PoshAnswers Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and PoshAnswers Inc.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement. Residents of all 50 U.S. states, the District of Columbia, and all Canadian provinces and territories are eligible to use the Service.
3. Description of Service
PoshAnswers provides analytics and market data derived from publicly available information on the Poshmark resale marketplace. The Service covers data from the United States (poshmark.com) and Canada (poshmark.ca). PoshAnswers is not affiliated with, endorsed by, or sponsored by Poshmark, Inc. The data we provide is for informational and analytical purposes only and should not be construed as financial, investment, or business advice.
4. Accounts and Subscriptions
Free Access. Certain features are available without creating an account. Free dashboard access is limited to prior-month U.S. Women's category data only.
Paid Plans. Paid subscriptions (Starter, Pro, Business) unlock additional categories, weekly data, Canadian market data, and other premium features. Plans are billed monthly on a recurring basis.
Cancellation. You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period you have already paid for. You will retain full access to your paid features until that period ends. No prorated refunds are issued for unused days remaining in a billing period.
Country Selection. Starter and Pro subscribers may select either U.S. or Canadian data as their default market, with one change permitted per calendar month. Business subscribers may toggle between markets freely.
Refunds. All subscription fees are non-refundable. Once a payment is processed, no refunds will be issued for that billing period, except where required by applicable law.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Reverse-engineer, decompile, or disassemble any part of the Service
- Attempt to gain unauthorized access to the Service or its systems
- Use automated means (bots, scrapers) to access the Service beyond its intended interface
- Redistribute, resell, or sublicense PoshAnswers data or analytics without written permission
- Interfere with or disrupt the integrity or performance of the Service
6. Intellectual Property
All content, trademarks, service marks, and data compilations provided through the Service are the property of PoshAnswers Inc. or its licensors. "Poshmark" is a trademark of Poshmark, Inc. and is used here solely for descriptive purposes. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal or internal business purposes.
7. Data Accuracy Disclaimer
While we strive for accuracy, PoshAnswers data is derived from publicly available information and may contain errors, omissions, or delays. We make no warranty regarding the completeness, accuracy, or timeliness of any data. You use the analytics data at your own risk and should independently verify any information before making business decisions.
Human and Artificial Intelligence Resources. The Service is created and maintained using a combination of human expertise and artificial intelligence. Both human- and AI-generated content may contain errors, inaccuracies, or omissions. This applies to all aspects of the Service, including but not limited to analytics dashboards, reports, newsletters, custom alerts, chat assistance, and seller resources. If you identify any errors, please contact us at our contact form so that we may investigate and correct them.
8. AI-Generated Content and Email Reports
Certain features of the Service, including email reports (weekly and monthly), analytics summaries, and AI-powered seller assistance, may utilize artificial intelligence to generate content. These reports and insights may also be reviewed and edited by humans before delivery.
Accuracy. AI-generated content and human-reviewed content may contain errors, inaccuracies, or omissions. You should verify all information independently before making business decisions based on any report or insight provided by the Service.
Acknowledgment. By subscribing to any paid plan that includes email reports, you acknowledge and agree that reports may be AI-generated, may be reviewed by humans, and may contain errors from either source. PoshAnswers Inc. is not liable for any decisions made based on the content of these reports.
Custom Alerts (Business Plan). Custom category alerts available to Business subscribers are generated and delivered automatically without human review. By enabling custom alerts, you acknowledge that these notifications are automated and have not been reviewed by a human before delivery.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POSHANSWERS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS (INCLUDING CERTAIN CANADIAN PROVINCES) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
10. Indemnification
You agree to indemnify and hold harmless PoshAnswers Inc. and its officers, directors, employees, and agents from any claims, losses, or damages arising from your use of the Service or violation of these Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections related to intellectual property, limitation of liability, indemnification, and governing law survive termination.
12. Governing Law and Dispute Resolution
For U.S. Users. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction. You agree to waive any right to a jury trial and to participate in class-action lawsuits to the extent permitted by law. Residents of states with specific consumer protection statutes (including California, Virginia, Connecticut, Colorado, and others) retain all rights provided under those laws.
For Canadian Users. For users residing in Canada, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any disputes shall be resolved through the courts of the Province of Ontario, unless the consumer protection legislation of your province of residence requires otherwise. Nothing in these Terms limits any rights you may have under the Consumer Protection Act, 2002 (Ontario) or equivalent provincial legislation.
13. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
